What is an Expert? (noun)
An expert is a person with specialized knowledge or skills. This person is an authority in any discipline that requires specialized knowledge and experience. Expert witnesses evaluate the facts of any matter at issue and assist by rendering a supportable opinion. This opinion may be provided for consultation purpose or as sworn testimony under oath.


What is a Witness? (noun)
A person who sees; or a testimony.

PROFESSIONAL CODE OF ETHICS

Area of Practice- Continential United States of America (USA). All 50 states governed by the Federal Manual on Uniform Traffic Control Devices (MUTCD). Including all state/county or local municipal manuals on uniform traffic control devices.

      Traffic control devices shall be defined as all signs, signals, markings, and other devices used to regulate, warn, or guide traffic, placed on, over, or adjacent to a street, highway, pedestrian facility, or bikeway by authority of a public agency having jurisdiction.

      The Manual on Uniform Traffic Control Devices (MUTCD) is incorporated by reference in 23 Code of Federal Regulations (CFR), Part 655, Subpart F and shall be recognized as the national standard for traffic control devices on all public roads open to public travel in accordance with 23 U.S.C. 109(d) and 402(a). The policies and procedures of the Federal Highway Administration (FHWA) to obtain basic uniformity of traffic control devices shall be as described in 23 CFR 655, Subpart F.

      Any traffic control device design or application provision contained in the Millennium Edition Federal MUTCD shall be considered to be in the public domain. Traffic control devices contained in the Millennium Edition Federal MUTCD shall not be protected by a patent or copyright, except for the Interstate Shield.

EXPERTISE
  To perform only in areas of competence dealing with the federal/state and local manuals on uniform traffic control devices.
  To express an opinion only when it is founded on adequate knowledge and honest conviction.
  To express an opinion and conclusions only when evidence in the case, and only to the extent justified by the evidence presented.

THE CLIENT
  To undertake professional assignments for which the expert is qualified, and to advise client to engage other experts whenever the client's interests are served best by such an arrangement.
  To apply all applicable training knowledge, skills, and mental abilities that are reasonable necessary for the best performance of the case.
  To be available to the client and promptly respond to all inquiries in a timely matter.
  To charge reasonable fees for services rendered (see fees); but not to accept fees on a contingency basis.
  To perform all responsibilities agreed upon in a timely, efficient and expeditious manner while in constant contact with client.
  To notify client immediately on any new discovery no matter how large or small the expert believes it could be.

SAFETY AND HEALTH
  To promptly call attention to any conditions that are dangerous or threatening to life, property or $'s.
  To pursue each case in a professional and technical manner to uncover any safety or health issues.
  To keep at all times an attitude of the safety and health aspects of the case.

CONFLICTS AND CONFIDENTIALITY
  To avoid conflict of interest; but to disclose the circumstances to all interested parties involved if deemed necessary.
  To treat all information confidential unless agreed and authorized by the client or court.

PROFESSIONAL RESPONSIBILITIES
  To honor and obey all laws pertaining to the profession. Oppose any untrue, unsupported, or exaggerated statement regarding the case. Carry out the duties of the profession in a manner so as to inspire the confidence of the client and the court.

FEES
  Seven factors in determining the reasonableness of a fee:
   1. The witness's area of expertise.
   2. The education and training required to provide the expert insight which is sought.
   3. The prevailing rates of other comparably respected available experts.
   4. The nature, quality, and complexity of the discovery responses provided.
   5. The fee actually charged to the party who retained the expert.
   6. Fee traditionally charged by the expert on related matters.
   7. Any other factors likely to assist the court in balancing the interests implicated.
 Each client will be quoted a fee arrangement according to the review of certain materials related to the situation. If both the client and expert agree to the terms of engagement then 100% Committment will be devoted to the client's case.
